How do I get a piece of property re-zoned in Phoenix?

Re-zoning is the process of changing the land use designation of a property to allow for different types of development. However, re-zoning is not a simple or quick process. It involves several steps and requires approval from various Phoenix agencies and officials.

Pre-application meeting

Before you submit your formal application, you should schedule a pre-application meeting with the Planning and Development Department staff.

This meeting will help you understand the requirements and procedures for your re-zoning request, identify any potential issues or concerns and get feedback on the site plan and design.

Application submission

After the pre-application meeting, you can submit your re-zoning application along with the required fees and documents. You will need to provide information, such as the legal description of the property, the existing and proposed zoning districts, the proposed land use and density, the site plan and elevations and a justification statement explaining why the re-zoning is necessary and compatible with the surrounding area.

Neighborhood notification

Once your application is accepted, you will need to notify the property owners within 300 feet of your site, as well as any registered neighborhood associations within one mile of your site. You will also need to post signs on your property indicating that a re-zoning request has been filed. You will have to provide proof of notification to the city staff.

Staff review and recommendation

The Planning and Development Department staff will review your application and prepare a staff report with their analysis and recommendation. The staff report will consider factors such as the compatibility with the General Plan, impact on public services and infrastructure, compatibility with adjacent land uses and the public input received.

Your re-zoning request will be subject to two public hearings: one before the Planning Commission and one before the City Council.

The Planning Commission is an advisory body that makes recommendations to the City Council on land use matters. The City Council is the final decision-making authority on re-zoning requests.

At both hearings, you will have an opportunity to present your case and answer questions from the commissioners or council members. You will also hear from city staff, other agencies and members of the public who may support or oppose your request.

Approval or denial

After the public hearings, the Planning Commission will vote on whether to recommend approval or denial of your request to the City Council. The City Council will then vote on whether to approve or deny your request at their next available meeting.

If approved, your re-zoning will become effective 30 days after the date of approval. If denied, you can appeal the decision to the Superior Court within 30 days of the date of denial.
