Eminent domain or condemnation laws allow municipalities, utility companies or the state of Arizona to seize private property for public use. When a person receives a notice that their property is being condemned, the property owner is entitled to just compensation for the property taken plus damage to the remainder of the property, if any.
There can also be inverse condemnation, which occurs when a governmental agency imposes regulations on your property or allows use of abutting property that restricts your rights to the full use and enjoyment of your property to such an extent that it constitutes a property “taking.”
